Novitą giuridiche is the scientific journal of the Tax & Legal Competence Center, launched in 2024, which addresses general legal topics across three major areas: civil, administrative, and criminal law. This innovative scientific publication, entirely digital and free of charge, aims to provide doctrinal support - in Italian - to the legal landscape of the Canton of Ticino and Switzerland.
The second publication of the journal Novitą giuridiche (NG), marking its first issue of 2025, opens with a contribution by Attilio Rampini on the topic of advertising by a lawyer and/or a law firm.
This is followed, within the same section on administrative law, by an article on short-term rentals for tourism purposes written by Massimo Nicora, and a third piece by Daniele Graber on competitive direct awarding in the context of public procurement.
Next are two civil law-focused articles: Massimiliano Maestretti, Lorenza Ferro, and Brian May discuss the rights and duties of information of board members, while Raffaele De Vecchi and Matteo Simona delve into a procedural consequence stemming from the revision that came into force on January 1, 2025, concerning the enforceability of decisions.
In the criminal law section, Fiammetta Marcellini reflects on medical expert reports and their use, with a particular focus on implications in criminal procedure, while Sara Menegalli explores the issue of evidence unlawfully obtained by a private party.
This first 2025 issue concludes its doctrinal section with an article on sports law: Sebastiano Tela and Emanuel Cortada present an analysis of the Field of Play doctrine.
Finally, the issue includes the first case law review published in NG: Stefan Protic analyzes the State’s economic activity in the private market.
